California Consumers’ Federated DriveSAFE℠ Notice at Collection

This notice addresses the California Consumer Privacy Act (CCPA) requirement, as amended by California Privacy Rights Act, (CPRA) that a business that collects personal information from a California consumer shall, at or before the point of collection, inform consumers as to the (1) categories of personal information to be collected from the consumer; (2) the purposes for which the categories of personal information are collected or used; (3) whether the information is sold or shared; (4) the length of time Federated Insurance intends to retain each category of personal information; and (5) the criteria used to determine the length of time Federated Insurance will retain the categories of personal information.  See CCPA §1798.100.

This Notice only applies to the “Services.”  “Services” include the Federated DriveSAFE Mobile Application (“Application”), the hardware telematics tag which will be affixed to a company vehicle (“Tag”), and the Fleet Portal which contains the telematics analytics in connection with the telematics program (“Portal”) as part of your employer’s participation in the telematics program with Federated. Further, this Policy only applies to Federated’s collection, use, and retention of Personal Information involving the Services.

The categories of personal information we may collect from you may include the following information if it identifies you or could reasonably be used, either alone or in combination with other data, to identify you:

  • Personal Identifiers: Name, e-mail address, IP address, photo (optional),
  • Employment Information: Your status as an employee of your employer,
  • Internet or other electronic network activity information: information regarding your interaction with the Portal or the Application, 
  • Geolocation data, including your precise geolocation while your phone is paired to a Tag and you are driving a company vehicle, but only to provide the Services you reasonably expect when using the Application and that are necessary for the Application to operate.
  • Electronic Information: information regarding your phone, including make, model, operating system and capabilities, your use of the phone while driving (e.g., texting, placing or receiving a call in a non-hands free manner, other use), information regarding the Tag’s Bluetooth connection to the Application, and general information about the number of nearby Bluetooth devices detected by your mobile device.

NOTE: We only collect driving information (including your precise geolocation) when your phone is paired to a Tag installed in your employer’s vehicle and you are driving that “tagged” company vehicle. We do not collect any driving information when you are driving your personal vehicle or any other non-work vehicle. Some limited non-trip data may be collected, such as Application settings when the Application is opened by End User, in order to create messaging for End Users to fix their settings and to help troubleshoot scenarios that an End User isn't able to record.

We do not collect any data regarding the specific contents of your use of the phone. For example we do not access or collect the text messages, phone calls/recordings, internet browser data, other application data, etc…. Only that the phone was used, other than hands-free, in some manner during driving.

Purposes for Which Federated is Collecting Your Personal Information

We use your information, including Personal Information in order to:

  • Provide you with the Services you requested.
  • Administer and maintain the Services, provide customer service, process or fulfill requests and transactions, verify your information, administer changes or amendments to the Services, provide analytic services and for Federated’s operational purposes which are reasonably necessary and proportionate to achieve the operational purpose for which the information was originally collected. 
  • Assist us in creating and developing safe driving programs for you and your employer.
  • Track your driving over time, identify potentially hazardous driving, and report results to you and your employer via the Application and Portal.
  • Confirm your identity and to assist you by providing customer and technical support regarding the application or Portal when you call Us to report a problem. 
  • Detect, prevent, and investigate potential security incidents that compromise the availability, authenticity, integrity or confidentiality of stored or transmitted personal information.
  • Protect against malicious, deceptive, fraudulent or illegal activity directed at Federated, and prosecuting those responsible for that activity. 
  • Undertake activities to verify or maintain the quality or safety of the Services, and to improve, upgrade, or enhance the Services.
  • Perform debugging to identify and repair errors that impair existing intended functionality.
  • Undertake internal research for technological development and demonstration.
  • Advance Federated’s lawful commercial or economic interests.

NOTE: Federated does not sell or share your Personal Information.

Federated retains each category of personal information described above for varying lengths of time.  

Retention periods will depend on the specific purposes for which we use or collect your information as well as legal retention requirements. For example, the retention period will depend upon how long you use the Services and how long you are employed by your employer and eligible to participate in the Employer’s DriveSAFE program. Retention will also depend upon how long the employer remains an insured of Federated.  The period during which we keep the information may also depend upon how long any related claims process takes as well as retention required by other relevant law. Since it is not possible to describe retention periods for each category of personal information, we apply the following criteria in determining the retention period:

  • How long you use the Application.
  • How long you are an employee of the company using the program, how long any related policy coverage is in force and any additional time in which a claim may be brought.
  • Legal requirements (including, but not limited to statutes of limitation and laws regarding audits of insurance companies) that require us to maintain the personal information.
  • Whether there is threatened or ongoing litigation, mediation or arbitration involving the personal information.
  • Whether the personal information is the subject of a valid court order or law enforcement directive to retain.
  • Retention to exercise or defend legal claims.
  • Compliance with federal, state, or local laws.

Federated does not retain a consumer’s personal information for longer than is reasonably necessary for each disclosed purpose.
